Right to Work Checks for self-employed are now here

1 min read

New Right to Work (RtW) rules come into force today, requiring construction firms to verify the eligibility of self-employed operatives as part of a renewed effort to tackle illegal migrant labour and non-compliant companies.

Until now, statutory RtW checks have largely applied to people classed as employees. However, the Home Office is now including self-employed operatives up and down the UK.

Companies will need clear records showing who carried out the RtW checks, when it was completed and that the person arriving for work is the individual who was cleared.

Companies that fail to carry out the required checks could face fines of up to £60,000 per illegal worker — increasing the pressure on contractors to tighten checks across their supply chains.

How can Mineral help?

Our team remove the risk regarding RtW checks as part of our onboarding process. These include:

✔️ Checking and verifying Right to Work documentation

✔️ Helping you understand which checks are required

✔️ Keeping the correct records and evidence of checks

✔️ Undertaking any follow-up checks where required

✔️ Offering practical support when you're taking on new operatives or subcontractors

Right to Work checks are an important part of getting your workforce set up correctly — and getting the process right from the start can help protect your business.

To date, we have undertaken over 2,000 checks as part of our onboarding process, ensuring our clients remain compliant at all times.
